DMCA and copyright policy

1. Our role
Ascendant Platforms, LLC, a California limited liability company, operates the EstateSail.com technology platform for discovering and managing estate sales. Much of the content on the Service (including sale listings, item photos, marketing images, and text) is provided by users. We do not pre-screen all user content. We may remove or restrict material when we receive a valid infringement notice or when we otherwise determine it is appropriate under our policies or applicable law.
2. Designated agent
Notifications of claimed copyright infringement under the DMCA should be sent to our designated agent:

If you send physical mail, use the same contact email first so we can provide a current mailing address if required. Electronic notice is preferred.
3. What to include in a DMCA notice
Your notice must include all of the following to allow us to evaluate and act on it:
- A physical or electronic signature of the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (for example, the URL of the listing or page on EstateSail.com).
- Information reasonably sufficient to contact you, such as an address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Incomplete or inaccurate notices may delay or prevent processing. If you are unsure whether material infringes your copyright, consider consulting an attorney before submitting a notice.
4. Counter-notification
If you believe material was removed or disabled by mistake or misidentification, you may send us a counter-notification that includes the information required by 17 U.S.C. § 512(g)(3). We may restore material in accordance with the DMCA if appropriate. Submit counter-notifications to the same designated agent with subject line “DMCA Counter-Notification.”
5. Repeat infringers
Consistent with the DMCA and our Terms of Service, we may terminate or restrict accounts of users who are repeat infringers of copyright in appropriate circumstances.
6. Other intellectual property
This process is intended for copyright claims. If you believe content violates trademark, privacy, publicity, or other non-copyright rights, email hello@estatesail.com with a clear description of the issue and URLs. We handle such reports in our discretion and as required by law.
7. Misrepresentations
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages. Please ensure your notices and counter-notifications are accurate.
