This Privacy Policy describes how Ascendant Platforms, LLC, a California limited liability company (“Ascendant Platforms,” “we,” “us,” or “our”) collects, uses, discloses, and protects information in connection with EstateSail.com, our mobile applications, APIs, dashboards, embeds, and related services (collectively, the “Service”). EstateSail.com is owned by Ascendant Platforms, LLC. It should be read together with our Terms of Service.

1. Who we are

The Service is operated by Ascendant Platforms, LLC, a California limited liability company, which owns the EstateSail.com brand. For privacy inquiries, contact hello@estatesail.com.

How we process personal information when you use professional or business features—including customer communications, transaction data, CRM functionality, and analytics tied to identifiable individuals—is described in the sections below. Related contractual data roles are summarized in Terms of Service Section 1; both documents should be read together.

2. Changes to this policy

We may modify this Privacy Policy at any time. We will post the updated policy on this page and change the “Last updated” date. Where required by law or where changes are material, we may provide additional notice (for example, by email or an in-product message). Your continued use of the Service after the effective date constitutes your acceptance of the revised policy unless applicable law requires a different form of consent.

3. Information we collect

We collect information in the following categories, depending on how you use the Service:

  • Account and profile data. Such as name, email address, password (stored as a hash), phone number, address or ZIP where you provide them, company affiliation, account type (for example shopper, private lister, or professional), and preferences you set in your account.
  • Listing and operational content. Sale titles, descriptions, photos, videos, inventory, pricing, schedules, locations, directions, terms you attach to a sale, CRM or lead data you enter, POS or receipt-related data you process through the Service, and similar content you or your organization submits.
  • Usage and device data. Log data, approximate location derived from IP or device settings, browser or app version, pages or screens viewed, referring URLs, timestamps, and diagnostic or performance data.
  • Cookies and similar technologies. As described in our Cookie Policy and in cookie banners or settings we provide, we use cookies, local storage, and similar technologies for authentication, security, preferences, and analytics.
  • Communications. Content of emails, support tickets, or in-product messages you send us, and metadata associated with those communications.
  • Payment-related data. When you pay fees or subscriptions, our payment processors collect payment card or bank details; we typically receive limited information (such as transaction status, last four digits, or billing address) rather than full card numbers.
  • Information from third parties. Such as data from authentication or integration partners if you connect them to the Service, or publicly available business information used to operate or improve the Service.

4. How we use information

We use the information above to:

  • Provide, operate, maintain, and improve the Service, including search, maps, routes, saved listings, Virtual Line, dashboards, APIs, and mobile features.
  • Create and manage accounts; authenticate users; enforce our Terms of Service and acceptable use rules (including anti-abuse and anti-scraping measures).
  • Process transactions, send receipts or invoices where applicable, and communicate about your account or the Service.
  • Send service-related and, where permitted, marketing messages; you may opt out of promotional emails using the unsubscribe link or your account settings where available.
  • Detect, prevent, and respond to fraud, security incidents, and illegal activity.
  • Comply with legal obligations, respond to lawful requests, and establish or defend legal claims.
  • Analyze aggregate or de-identified usage to understand how the Service is used and to develop new features.

5. How we share information

We may share information as follows:

  • With other users and the public as needed to operate the Service—for example, listing details, company profiles, and shopper-facing features you choose to use are visible according to your settings and the nature of the product.
  • With service providers who assist us (hosting, email delivery, analytics, maps, payment processing, customer support tools, security monitoring), subject to contractual obligations to use data only on our instructions and to protect it appropriately.
  • For legal reasons when we believe disclosure is required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Ascendant Platforms, LLC, our users, or the public.
  • In connection with a business transaction such as a merger, acquisition, financing, or sale of assets, where information may be transferred as a business asset; we will require the successor to honor this policy or notify you of changes as required by law.
  • With your direction or consent.

We do not sell your personal information for money as that term is commonly understood in U.S. state privacy laws. We may use advertising or analytics partners as described above; see Section 9 for California rights.

6. Retention

We retain information for as long as necessary to provide the Service, comply with law, resolve disputes, and enforce our agreements. Retention periods vary by data type and context; for example, we may keep backups for a limited period and may retain certain records after account closure where required for legal or security reasons.

7. Security

We implement technical and organizational measures designed to protect information against unauthorized access, loss, or alteration. No method of transmission or storage is completely secure; we cannot guarantee absolute security.

8. International transfers

We operate in the United States. If you access the Service from outside the United States, you understand that your information may be processed in the U.S. and other countries where we or our providers operate, which may have different data protection rules than your country. Where required, we use appropriate safeguards for cross-border transfers.

9. U.S. state privacy rights

Depending on where you live, you may have rights to access, delete, or correct certain personal information, to opt out of certain processing (such as “sale” or “sharing” for cross-context behavioral advertising under applicable state laws), or to appeal our decisions. To exercise rights, email hello@estatesail.com with your request and enough information for us to verify your identity. We will not discriminate against you for exercising these rights. You may also use an authorized agent where permitted by law.

10. European Economic Area, UK, and similar regions

If applicable data protection law grants you rights (such as access, rectification, erasure, restriction, portability, or objection), you may contact us at hello@estatesail.com. You may also lodge a complaint with a supervisory authority in your country. Where we rely on legitimate interests, we balance those interests against your rights; where we rely on consent, you may withdraw it at any time.

11. Children

The Service is not directed to children under 13 (or 16 where a higher age applies under local law), and we do not knowingly collect personal information from children in that age group. If you believe we have collected such information, contact us and we will take appropriate steps to delete it.

12. Third-party links and services

The Service may link to third-party websites or embed third-party tools. Their collection and use of information is governed by their own policies. We encourage you to read those policies.
